2008 200 series starter sticks in a few seconds after sitting

I have a 200 series wagon (2008) , starter had been sticking in for a few seconds after start up so i just thought starter on its way out. I replaced starter and problem is still there. It is only after first start up, then after that it is fine, am thinking it musnt be getting correct signal when cold to cut out starter cranking when engine starts running. Does any one know where or what sensor give info to ECU to control starter? Thanks
