LOSS OF LISENCE... AGAIN ><

Ok Before any of you start blasting me for Hoon driving or Another P plater doing something illegal > learn to keep your critisism to yourself... expecialy if you dont know the full story.

Ok now that we have put that aside

I was driving 2 nights ago to see one of my clients at Holden Hill Fitness First (im a part time Personal Trainer and full time Account manager)

Coming allong North east Rd I was pulled over by a Police Officer on a Motor bike.... he wouldnt come to me, but instead made me come out of my car so he could talk to me at his motor bike. He claimed i was doing 74 in a 60 zone, Shoked at the fact i had no REASON to speed and my Speed allert in my car DID NOT go off (its always set to 65 and as many of you know in the Camry the bloody thing doesnt stop beeping at you for ages if your over the speed limit... so i try not to anger it )

I didnt argue with the guy (its pointless... your arguing with 2 ppl.. the officer and the uniform and i had no eye witness)

But i did state that the speed allert didnt go off in my car and that i wasnt aware that i was speeding... Didnt get me any where and i still got the fine... When i asked the officer how many points i would loose he stated 1 point and he stated that if i wanted to bring to dispute it the number on the back of the fine yada yada yada....

I drove off... funny enough in a good mood.

now heres the problem.

Ive lost my lisence twice now >Collection of demerit points.

and ive been on my Provisionals for 4 years now. because of the new P plate laws.

when i got it back last year i was given a Curfue (12:30 i had to be off the streets, wasnt alloud to drive and wasnt alloud to be in a high performance vehicle after 12:30 till 6am) wich i obbeyed and followed all the rules.

So now i have a dillema...

Do i sit out the 6 months and then go to motor reg to pay $120 to get my L lisence back so that i can sit my $160 Learners Test (the practical last exam) so that i can go back to the motor reg and pay an extra $90 so that i can get my P lisence back... (and then they wonder why soo many ppl drive unlisenced... its soo expensive to get it back and then its soo easy too loose it... even if you Slip up once it theres no If or Buts to help you out... THAT IS UNLESS YOU HAVE TITS and thats not being sexist... ive seen it happen.

So, My question is this

What do you guys think i should do?

and Who else has been in a simmilar situation.

This isnt a topic open for Roasting (if i needed to be roasted ide go to a elderly home and here them complain about hodlems and hoons.)

I am not a hoon I DO NOT DRIFT IN STREETS, RACE AT TRAFFIC LIGHTS, DO BURN OUTS ON PUBLIC ROADS, ABUSE THE LAW EXCESEVILY

i dont understand your question isnt there only one option which is go through the whole process again? u havnt stated the other option whatever that is?

Appeal it if you believe you are in the right, otherwise it's just something they hang on you another time down the track. Viscious circle? Otherwise, just cop it on the chin and move on.

Lidars are so very suitably named...

Its just so annoying, I see Imbacels every day do rediculas stupid ******* not to mention 3 cars have been broken into at the front of my house in 2 weeks.. ( my sisters and my sisters freind.. i plan do something about myself ive got an idea who it is)

and when you ring the police regarding anything like robbery/car being broken into they just dont seem to care or prioratise it any more... So ive got an idea... Next time my car is getting broken into i will call the local branch and claim "4 bikies are doing drugs. hooning around while breaking into my car" ... key word there is Hoon/Bikies/Drugs :P

lets see how fast they react to that :P

yea the laser gun read 74km.

But the thing i dont get is that im 100percent certain that i wasnt speeding. Unless there was interfearence.

Does any one know what i can use to my defence?

Lidars are gay and uselss. The only thing you could ask for is the service history for the actual unit used to catch you, and also the conditions under which the policeman was using it in. If the unit is past it's service requirement, or if it was used in a manner not allowed in the manual, you might have a very very slim case.

Most of the time, they are taking the speed of a car way behind you, and pick out the most noisy/ricey/sporty looking car to pull over... But if you were the only one around, WTF can you do? I'm wanting to get a system setup in my car that monitors my behaviour for the last 5-10mins (whatever) for things like this.

I just rang up 1800 659 538 (fine pay unit and dispute unit) no matter what i told them the woman was agro and just wouldnt listen, not to mention she sayd they have to lock onto your car for 5 seconds before they get a readout (i was 300m away from the police officer or so he stated. at 74km i would have past him?)

she also sayd that if i was the only car there (wich i was there where other cars behind me) that theres nothing i can do about it and to just pay the fine (WTF INSTEAD OF HELPING THERE WORRIED ABOUT $$ its not the cash thats an issue its the lisence thats an issue for me)

I have to ring up 1300 360 067 (again) and ask them what i can do to dispute it... they are going to tell me to ring 1800 659 538 (fine pay and dispute number again) its a merry go round... Why bother with this police state any more -_-'

A written letter to the head of the station (or whatever the hell the fat guy is called) isnt going to do squat she told me.

So my options on there end is to simply give them the cash > and get off the road...

Going to try motor reg again.

BTW, the servicing rule doesn't apply for LIDAR. Used correctly, they are basically flawless in their readings. All you can dispute it on is how the device was being used, which I don't think you have the proper grounds to base any case on.

Cop it on the chin and move on. Also ring up your local taxi place and ask them where they get their speedo's calibrated. Might be a good idea to make sure yours is accurate for the future.

speedo is fine/ have GPS in the car and that has annoying beeping thing that tells me if im over the speed limit... EVEN THAT DIDNT GO OFF AND THAT TELLS ME WHAT SPEED THE AREA IS AND WARNS ME IF IM 2KM OVER

no point arguing.... im gona get no where.... It just means i whont be stopping if i see a officer bleed on the side of the road... as harsh as it may sound.

people are given a number of two week extension periods... and the points are only deducted after the admission of guilt

there was a guy on the magna forums who was on his reds and was caught speeding. managed to delay the fine until he got his greens. kept his license.

that work for you?

Doesn't happen, offence date is the date the penalty gets applied to your license.

Yep and even then I get off my P's in 3 years so it wouldnt work.

P1 i was coming off in 4 months but the Loss of lisence is taken action once the fine is payed (technicaly if i didnt pay the fine EVER i wouldnt loose my lisence... I would go to Prison but not loose my lisence :P )

It sure can be. Here in Queensland they state:

MY VEHICLE PICKED UP SPEED ONLY BECAUSE I WAS DRIVING DOWN A HILL. CAN THE INFRINGEMENT NOTICE BE WITHDRAWN?

No. The physical characteristics of the road should not control the speed of vehicles travelling upon it. It is prudent for a driver to utilise the braking system fitted to their vehicle if the downgrade is such that the vehicle could move faster than the stated speed limit.

I'm sure other states will have similar.

I feel sorry for you guys I cant even understand how the whole P plate system works anymore it is so complicated and completely useless.....

SMASH THE STATE!!!!!!

Anyway I find it hard to believe both your GPS and Car speedo could possibly have been so wrong!
