On the open roads in Northern NSW, the police are notorious for sitting at the end of an Overtaking Lane getting people doing over the speed limit.

Essentially, the rules are clear. You can not speed. Overtaking lanes do not give anybody the right to speed, as inviting as they are sometimes :P however I doubt very much that if you are on a single carriageway doing 90km/h behind a slow dude and you accelerate to 103km/h to get past him and it is a 100km/h zone, I doub't you'd get sprung.

The 10% lee-way that people talk about is a myth, it's Police discretion....

dude we are not slightly permitted to speed at all

if you and the car directly next to you is going same speed and your in the merging lane then you should slightly back off and merge in behind him

then why did u give that scenario then... OBVIOUSLY I KNOW NOT TO OVERTAKE WEN i shouldnt...

i only said that bcoze u have no clue wat an overtaking lane is... and regarded it as a merging lane. i sense uv only just got ur P's u should go do some country cruising before u assume an overtaking lane is a merging lane

while ur at it get a few cops to go with u whilst ur in the country... then go side by side and 1 following on the merge lane at the speed limit lets act out the scenario and see wat u do.. do u speed or do u brake... ohhh did i mention theres the cops behind u in the scenario.

also to clarify the slightly speed part... its using speeds to overtake the person in the other lane.. i did not say DRAG THE crap out of him and overtake his *****.... dont just assume that what i said was "SPEEDING", i said using speeds in which was appropriate to overtake in other words. HENCE WHY I SAID "slow truckies building up speed" in the following part. Speed can be interpreted many ways. Not just disobeying the law. Maybe my english isnt good enuff to explain the term speed to P platers.

i havent only just got my licence at all

i do know the difference between an overtaking lane and a merging lane

... you'll find many P platers have a greater understanding of what the rules are than most people who have had their licenses for a few years. they have to learn the rules for their license test...

when was the last time you read any road rules?

get a life and leave evl alone - ive seen him contribute more to the forum than you have.

The law, as Buddha also clarified, is that when the speed on a carriageway where there is two or more continuous lanes in the same direction is 90km/h or higher, then you are only permitted to be in the Right lane when overtaking unless the other lanes are blocked or congested.

No, your English isn't very good. By the way, some capital letters and full stops wouldn't go astray.

Speeding by definition in Australian Road Rules is deemed to be travelling at a speed excessive for the conditions. (I thought I mentioned this in an earlier post). If you need to do 115km/h in an overtaking lane to pass somebody, then you are speeding unless the overtaking lane is a 115km/h zone.

You have to remember that if you need to merge into someone elses lane be it an ending lane you are in or overtaking, that you have to follow give way rules. If your lane comes to a definitive end and you are side-by-side with someone, then you must slow down, give way and pull in behind them. No Police Officer will ever write you a ticket for that and if they do, I am sure that your local Magistrate's court will see your side of it.

I've often found myself in a situation where I'm in an overtaking lane, but there is a slower vehicle ahead but their lane would end before I would be able to pass them ... it doesn't hurt in those circumstances to just ease off the throttle and allow them in, then wait patiently for the next overtaking opportunity.

I'm certainly not disagreeing with Azza as far as merging goes, but sometimes at 100 or 110kmh, its better to just show some courtesy rather than almost cause an accident just because you believe the written law is on your side. Same with people merging from an on-ramp ... it doesn't hurt to drop back to 90-95, or change lanes briefly, to allow someone in.

Besides, if an accident should occur, you'll find that there are rarely any situations where one person is considered 100% at fault, in fact in these cases the relevant insurers might consider you even 50% to blame, regardless of the letter of the law.

The thing is too Steve, that if there is the remotest chance that you have some way breached ANY traffic offence, then usually the insurance company will try and find it so they don't have to pay...

But you'd know that after working with insurance :P
