sppeding fine

hey guys, on Tuesday night i was going home from work, and i was irresponsibly driving, there was absolutely no one on the road, so i decided ill just floor it down the highway, to get home faster, it was late.

anyway, as i went past a bunch of trees i see the reflection of the police symbol on a ss cop car. oops. next thing i know i have been pulled over.

basically its a 55km/h over speed limit fine he says he got me doing 155 in a 100 zone, im not bragging abou tit, im actually ashamed of it and i have kicked myself for it.

its a court case as it doesn't fall below 45 km/h. so i go to court and get my license taken off me for god knows how long.

but the day after i checked my gps and it says i only did 141km/h. This speed doesn't get me into the court bracket and i just lose my license for a little while and get a fine.

i was just wondering what i should do with this info, i had a look and gps info does get accepted in legal things.

so any ideas

Present it to the court as evidence.

Since there is quite a large difference between speeds recorded, it can be argued the police scanner was not accurate. Precedence can be drawn from past cases, and as I recall there was quite a bit of an argument not too long ago as to how accurate these scanners the police use actually are.

i want to somehow use it to get myself out of having to go to court. as i seriously don't have enough money to pay court charges

There are a couple of solicitors that specialise in this area - check in the speicifcations pages of Motor magazine or try the yellow pages. I know you don't have the money for court charges, but I can't think of another way around it without consulting a solicitor.

My sympathies. I just got my licence back after 3 months scabbing lifts and riding buses. My guess is that you will lose your licence for six months and pay a solid fine.

I wish you all the luck in minimising the damage here.

i would also like to say that i really cant imagine the car i was driving in could go that fast (its a hyundai getz), 155 in a getz is pretty crazy. and plus, my gps says i only did 141, which is believable for a getz, but def on its high end.

i dunno, i just dont think i was going basiically 160. im in darwin, i am on my last few months of my P's. i was on the double or nothing scheme where it gives me 2 points for 12 months (cos i had already lost my 6 P plate points for speeding tickets. ). its fully up to the judge what my fine and stuff will be.

if im below the 145lm/h bracket i lose it for 6 months with a fine. i would much rather that way

Any little piece of evidence will help in court. I had an insane run one night where i lost 18pts (12pts for running 4 red lights and 6pts for 45km/h over the limit) in one hit and im really ashamed of it. The police lawyer proposed 2 years license suspension plus my fines ( which added up to $2200) and a fine for negligence ( $2800). Anyway my argument was why would the police allow me to continue after the first one or even the second one or even the third red light. My lawyer said had the police done their job according to their protocols, i would have never have been in the court room and i would have learned my lesson from one red light fine. He argued police never wait for a criminal to finish his crime so why wait until im finished. I ended up just getting 6month suspension but all the fines.

Anyway my point is, police make errors and the courts know that, all you have to do is forward the evidence and be remorseful.

There are lawyers who only deal with police matters relating to traffic offenses. If you cant afford one to represent you, they offer you advice over the phone. you got nothing to lose. I know the feeling mate, all the best

i think i have seen a link to a speeding and traffic fine consultant in someones sig...ill keep my eyes open.

By the way, if your gps is mounted in your car there is nothing to say it wasnt in the car at the time... Also remember that the police now have lapelle microphones and record what you and the officer say. If you agreed to the speed that you were allegedly doing I dont know that they will accept it but hey worth a try.

Well..he can say he agreed to the 'speeding' above the limit, and that is at his fault, but not to the extent of above 55km/h. He felt guilty that he said yes to evrything but after double check, he was only speeding above 41 instead of 55. That should at least reduce penalties..

I still remember the night I was coming back from seeing Ferry Corsten @ Home Nightclub, we stopped at the servo just outside Sydney there, I thought my mate took off in his liberty to lose us, so I took off down the highway doing 190km/h and kept doing that speed till golburn trying to catch him, was HEAPS foggy so I thought I should slow down, no joke, 5 seconds after I had gotten on the anchors down to about 130km/h ol johnny hopper was sitting there HAHAHAHA turns out my mate drove round the back of the servo to the toilet cause it was too cold for his girlfriend to walk round the back. lucky I was clocked at 130 not 190km/h LOL

I copped the fine tho, moral of my story, be a goose and take the slap on the wrist.

u know whats funny, when u see cops on street patrol, just as pass them in your car give it a boot full and just hammer your car as hard as u can past them :lol: i know its childish but it s a s funny as **** (to me any way) cause theres nothing they can do, unless one of the cops happens to be the cop from terminator 2 and starts chasing u down...... :(

If you simply lose you license and cop a fine you will be lucky. 40 over the limit, 2nd offence, P-plates....

Sorry buddy, but I'm predicting long term license loss and potential criminal record.

Won't help, can't prove your GPS is accurate nor was actually in your car at the moment. As for ACA/Today Tonight - everything they've ever said on speeding fines is basically a lie. You won't get off it unless you have definitive proof you weren't speeding (which you don't have), or can prove the speed camera they were using is innacurate (which RARELY will happen).

If it was me cop it on the chin, plead your case to the judge (irresponsible act, now know the full consequences of your actions, etc) and pray to God they will be lenient (it can happen, although everything is currently against you). If you're in QLD, you can work on the hardship ruling if the circumstances are right - it's not a full license, but it may help (I believe you have to be done for either hooning or DUI though).

Won't make any difference what he says. Anything a police officer says is taken as fact in court, and by trying to change his story now will only make things worse.

LOl. theres this spot on the princess hwy near stgeorge tyres where cops stand on the hill with a gun i drive below the limit by 10 and when im next to them i drop a gear and roar past they always turn and have that what car was that look lol. fun fun but childish.

not that when i roar past i just accelarate from 50-60 ina lower gear nothing silly :P

In all seriousness, forgetting the above attempt at humour, have you taken nothing at all from this forum other than some constant desire to see who can get away with being the biggest delinquent?

You are in a thread about how a member has actually been busted for driving like a douche and, instead of counting your blessings you haven't been caught, you decide to tell the world how much fun you have winding up the police!

You have a wealth of people you could try to compete with on this forum - and actually learn from - (Xoom, Superdave, Chicaboo, Hiro, BKS etc... and especially in your case Will, you should be paying particular attention to JVN11), but instead you would rather compete with those members that give the rest of us a bad name...

I may only be new on here but mate you need to cop what ever they give you on the chin. Yeah you may have been a d*^k on the road but beleive you me how would you be feeling if you crashed and took them out and maybe their life or yours? I'm no do gooder either but I was never going to put my life or anyone elses life in danger on the road. They have race tracks we can use with all the safety gear and big run off zones. My wife is a nurse and has spend a bit of time helping kids put themselves back together. It's not nice she assures me. She now works within the jail system and has had a few young kids in for speeding, there was this one young guy who got done and was doing 6 months, he was s*^t scared of the place. Ended up in protection and said that after a week inside he wasn't going to be an idiot on the road again. He'll go to the track now.

I've lost a mate to speeding and let me tell you the family has never recovered and probably never will.

We have a corner near our house that is off camber and sharp, The amount of cars that crash there due to speeding is at least once a month. Of the cars that I or my wife has seen 99% P Plates, why? Too fast, too confident about their ability.

Just take it easy out there.
